The basis on which we quote and work.
1. These terms
These terms govern quotations issued by and work carried out by BRAND (LICENCE). By instructing us you accept them unless we have agreed different terms in writing.
2. Quotations
Quotations are valid for QUOTE_VALIDITY from the date of issue and are based on the information supplied to us. Where site conditions differ materially from that information, we will notify you before proceeding and agree any adjustment in writing.
3. Site conditions and access
The client is responsible for providing safe access to the work area, and for confirming the availability of power and water where these are required. Standing time caused by access being unavailable at the agreed time is chargeable.
4. Structural work
We do not cut structural elements without a structural engineer's design covering propping, load transfer and sequencing. Where such a design is not available, we will decline the work.
5. Scanning and concealed services
We scan the cut zone before structural cutting and mark our findings. Ground penetrating radar has limitations and cannot guarantee detection of every embedded object. Our liability for damage to concealed services is limited as set out in clause 8.
6. Payment
Payment terms are PAYMENT_TERMS from invoice date unless agreed otherwise in writing.
7. Waste
Removal and disposal of cut material is included where stated in the quotation. Waste transfer documentation is issued on request.
8. Liability
We maintain public liability insurance to COVER. Our liability is limited to the level of that cover. We are not liable for indirect or consequential loss including loss of profit or programme delay.
9. Governing law
These terms are governed by the laws of the United Arab Emirates and the courts of EMIRATE have exclusive jurisdiction.
